1. Introduction

Welcome to the GenSELECT Portal. These Terms and Conditions ("Terms") govern your access to and use of the GenSELECT Portal website and services (collectively, the "Service"), provided by the Agricultural Business Research Institute (ABRI) ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

The GenSELECT Portal facilitates the management of genomic testing orders and the delivery of Genomic Breeding Values (GBVs). The service workflow is as follows:

• You create an order within the Portal and receive an Order Batch Number.
• You provide this Order Batch Number along with your tissue samples to an approved laboratory.
• Payment for laboratory services is arranged directly between you and the laboratory.
• The laboratory provides SNP data to ABRI.
• ABRI processes this data to generate GBVs and makes them available to you via the Portal.

3. Data Ownership and Use

GBV Data: ABRI retains full ownership of all Genomic Breeding Values (GBV) data generated through the Service. You are granted a non-exclusive, non-transferable license to access and use the GBV data for your own breeding and business purposes.

Input Data: By submitting orders and facilitating the transfer of genotype data to us, you grant ABRI a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, and analyse such data for the purpose of providing the Service, conducting research, and improving our genetic evaluation systems.

4. Payment and Fees

Currently, the GenSELECT Portal service is provided without a direct fee from ABRI, though this is subject to change. You acknowledge that you are solely responsible for all costs associated with tissue sampling, shipping, and laboratory testing fees. We reserve the right to introduce fees for the Service in the future, upon reasonable notice to you.

5. Disclaimer of Warranties and Limitation of Liability

Please read this section carefully as it limits our liability.

Nature of Genetic Predictions: You acknowledge that Genomic Breeding Values (GBVs) are estimates based on statistical probabilities and current scientific knowledge. They are not guarantees of future performance or specific outcomes. Actual results in progeny may vary due to environmental factors, management practices, and random genetic inheritance.

No Professional Advice: The data provided through the Service is for information purposes only. It is not intended to replace professional advice. We strongly recommend seeking assistance from a qualified breeding consultant or veterinarian before making significant breeding or financial decisions based on this data.

Indemnification: To the maximum extent permitted by law, ABRI excludes all liability for any loss, damage, cost, or expense (including consequential loss) incurred by you or any third party arising from or in connection with your use of the Service or reliance on any data provided (including GBVs). You agree to indemnify and hold ABRI harmless from any claims resulting from your breeding decisions or use of the Service.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.

6. Account Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for any reason, including but not limited to a breach of these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising out of or relating to these Terms.
